General Terms & Conditions of Sale

Article 1: Scope, Merchant Identity & Tax Status

These General Terms and Conditions of Sale govern all sales on machikoulidana.com.

The website is operated by Machikoulidana (Thai Willy EI), a sole proprietorship registered in France under SIRET number 107 761 116 00014, located at 173 Rue de Courcelles, 75017 Paris, France.

VAT is not applicable according to Article 293 B of the French General Tax Code (CGI).

Article 2: Payment & Currency

The currency of the contract is the Euro (€). All payments are processed in EUR. Currency conversions (USD/GBP) are for informational purposes only and may vary depending on exchange rates. Customers are responsible for any additional fees charged by their bank or payment provider.

Article 3: Production & Delivery

All items are made to order using a print-on-demand model. Production begins only after payment is confirmed. Delivery times are estimates and may vary depending on destination, production workload, or shipping carriers.

Orders shipped outside the European Union may be subject to customs duties, import taxes, or local fees, which are the responsibility of the customer.

Article 4: Right of Withdrawal

In accordance with Articles L221-18 and following of the French Consumer Code, you have 14 days from the delivery of your order to withdraw from your purchase, without having to give a reason.

To do so, send us a clear statement of your decision at contact@machikoulidana.com, for example using the model form at the end of these terms. We will reply with the return address. You must then send the items back within 14 days, unworn, unwashed and in their original condition. Return shipping costs are paid by the customer.

We will refund the price of the items and the original standard shipping cost within 14 days of receiving your withdrawal request. We may wait until we have received the returned items before issuing the refund. The refund is made using the same payment method as your order.

Article 5: Defective, Damaged or Incorrect Items

If you receive a defective, damaged, or incorrect item, please contact us at contact@machikoulidana.com with your order number and clear photos of the issue.

Depending on your choice, we will send you a replacement or refund you, at no cost to you.

Article 6: Legal Warranties

In addition to the above, all products benefit from the legal warranty of conformity (Articles L217-3 and following of the French Consumer Code), which lasts 2 years from delivery, and from the warranty against hidden defects (Articles 1641 and following of the French Civil Code).

Article 7: Intellectual Property

All designs, visuals, characters, illustrations, and branding elements of Machikoulidana (Thai Willy EI) are protected by intellectual property laws. They may not be reproduced, distributed, or used without prior written permission.

Article 8: Customer Responsibility

Customers are responsible for providing accurate information when placing an order, including size selection, delivery address, and contact details. We cannot be held responsible for errors resulting from incorrect information provided by the customer.

Article 9: Applicable Law & Disputes

These terms are governed by French law. If you have a problem with your order, please contact us first at contact@machikoulidana.com, and we will do our best to find a solution together.

If no agreement can be reached, the dispute may be brought before the competent French courts. As a consumer, you may also rely on the mandatory protections of the law of your country of residence.

Complete and return this form only if you wish to withdraw from your purchase. You can copy it into an email sent to contact@machikoulidana.com. Using this form is optional: any clear statement of your decision is enough.
